Tips for a Successful Mediation



  1. Prepare yourself and your client for mediation. There are things that attorneys should do to prepare for mediation, but you should also remember to prepare your client for what to expect from mediation.

  2. Provide all pertinent documents to the mediator before mediation. This allows the mediator to spend time during the mediation helping to resolve the issues at hand rather than wasting time catching up on the basic facts of the case.

  3. Appreciate each party's different perspective in the mediation. Try to put yourself and your client in the other party's shoes. It is possible to stand strong in your position while appreciating another position.

  4. Remember to listen. Do not listen with the intent to reply, but with the intent to understand. Listening during a mediation is perhaps the most important thing to remember. Listen to not only your client but to the mediator and the other party.

  5. Be patient. Remember mediation is a process.
